1. About FYKicks

FYKicks is a free, non-commercial sneaker concierge and search project. We search third-party marketplaces, boutiques and private sellers to help users locate relevant offers for new and used footwear worldwide. General enquiries may be sent to concierge@fykicks.com, and partnership enquiries to partners@fykicks.com.

By submitting a sneaker search request, you confirm that you have read and accepted these Terms.

2. Our role

FYKicks does not sell sneakers and is not a party to a purchase between you and a third-party seller unless we expressly state otherwise in writing. Any purchase, payment, delivery, return, guarantee, authenticity assessment or dispute is governed by the seller’s terms and applicable law. You should review the seller, listing and terms before purchasing.

3. Free service

The FYKicks sneaker search service is provided entirely free of charge. FYKicks does not charge users a commission, subscription or search fee. At the date of these Terms, FYKicks does not receive commissions or other payment from sellers, does not use affiliate links and does not operate paid advertising connected with search results.

You may submit product details and contact information so that we can search for potential matches. We may send one or more offers or links, but we do not promise that a match will be found, remain available or meet a particular price, delivery time or condition. You pay only the independent seller and any taxes, shipping, customs or payment charges disclosed in the relevant transaction.

4. Offers and third-party information

Prices, availability, product descriptions, images, condition, authenticity claims and delivery information originate from third parties and may change without notice. We take reasonable care when sharing offers but cannot guarantee that third-party information is complete, current or error-free. A link or reference does not constitute an endorsement or warranty.

5. Your responsibilities

• Provide accurate, current information and an email address you are authorised to use.
• Use the website only for lawful, personal or otherwise authorised purposes.
• Independently check the seller, product, sizing, condition, authenticity, total cost and transaction terms.
• Do not attempt to disrupt, scrape, reverse engineer, misuse or gain unauthorised access to the website or its systems.
• Do not submit unlawful, misleading, harmful or third-party confidential information.

6. Accounts and eligibility

No account is currently required to submit a request. You must have the legal capacity required in your country to use the service and enter any resulting transaction. Minors should use the service only with the involvement and permission of a parent or legal guardian.

7. Intellectual property

The FYKicks name, logo, website design, original text, graphics and other original site materials are owned by or licensed to FYKicks and are protected by applicable intellectual property laws. Third-party names and trademarks belong to their respective owners. You may not reproduce or commercially exploit our materials without prior written permission.

8. Technical requirements

To use FYKicks, you need an internet-connected device, a current web browser, access to an active email account and enabled functionality necessary to submit website forms. You are responsible for the cost and security of your own connection and device.

9. Availability

We may update, suspend or discontinue any part of the website or concierge service. We may decline or stop handling a request where it is incomplete, unlawful, abusive, technically impractical or inconsistent with these Terms. We will try to avoid unnecessary disruption but do not guarantee continuous availability.

10. Service complaints

A complaint concerning the operation of the FYKicks website or our sneaker search service may be sent to concierge@fykicks.com. Please describe the issue, when it occurred and the email address connected with the request. We will make reasonable efforts to respond promptly.

Complaints about footwear, payments, delivery, returns, warranties or a purchase transaction should be directed to the relevant seller or marketplace.

11. Liability

Nothing in these Terms excludes or limits liability that cannot legally be excluded, or any mandatory consumer rights. To the extent permitted by law, FYKicks is not responsible for a third-party seller’s acts or omissions, third-party products or services, marketplace downtime, or indirect losses that were not reasonably foreseeable when you used the service. You remain responsible for deciding whether to enter a third-party transaction.

12. Privacy

Our Privacy Policy explains how we process personal data submitted through the website. Ordinary customer enquiries and related correspondence are kept only for as long as necessary to handle the enquiry or matter, but no longer than 12 months after its handling has ended, and may be deleted earlier as soon as they are no longer needed. They may be retained for longer only where required by law or where necessary to establish, exercise or defend legal claims.

14. Governing rules and disputes

These Terms are governed by applicable Polish law, without depriving consumers of mandatory protections available under Polish, European Union or the law of their country of residence. Before starting formal proceedings, please contact us so we can try to resolve the issue. Any dispute may be brought before a court with jurisdiction under applicable law.

15. Prohibited conduct

You must not use FYKicks to commit fraud, impersonate another person, infringe intellectual property, distribute malicious code, send unsolicited commercial messages, test system vulnerabilities without permission, or collect information about other users. We may restrict access where reasonably necessary to protect users, FYKicks or third parties.

16. Communications and electronic delivery

You agree that service-related notices, search results and replies may be delivered electronically to the email address you provide. You are responsible for checking that address and its spam folder. A message is not a binding offer by FYKicks to sell a product.

17. Severability and no waiver

If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law. A delay or failure by FYKicks to enforce a provision does not waive the right to enforce it later.

18. Entire understanding

These Terms and the Privacy Policy form the understanding between you and FYKicks concerning use of the website and concierge service. They do not replace the separate terms that govern any transaction with a third-party seller or marketplace.

19. Changes to these Terms

We may update these Terms where reasonably necessary because of changes to the service, applicable law, technology or security requirements. The current version will be published on this page with its effective date. Changes will not retroactively reduce rights already acquired under applicable law.
